Terms and Conditions

1. Pricing and Payment

• Pricing follows Encore by Welltek's policies at marketplace.reseat.com

• Three seller plans with different profit-share levels are available

• Consignors set prices; items unsold after 6 months may be removed

• Payment occurs within 15-30 days after buyer delivery and approval

• Encore by Welltek reserves the right to decline listing items

2. Selling Policy

Encore by Welltek requires exclusive selling rights to all items being stored by Encore by Welltek. Items stored are considered under contract. If consigned items sell elsewhere, Encore by Welltek receives 50% commission plus storage fees. All consignors must be approved before posting items.

3. Item Description

Consignors must provide accurate details including brand, name, dimensions, and photographs.

4. Condition Requirements

• Minor repairs may be required

• Upholstered items need light or deep cleaning before listing

• Cleaning/refinishing services available at consignor's expense

• Encore by Welltek not responsible for damage from service providers

5. Inspection and Removal

• Consignors make items available for buyer viewings

• Consignors responsible for disconnecting power

• Buyers arrange pickup or delivery (buyer pays shipping)

• Listings include "date available" and "date to be removed"

6. Damages and Defects

Consignors must disclose all visible and invisible damages with supportive pictures required. Encore by Welltek SHALL NOT BE RESPONSIBLE FOR ANY UNDISCLOSED HIDDEN DAMAGES. If a buyer refuses due to inaccurate condition description, the consignor pays return shipping.

7. Representations and Warranty

Consignors warrant that all provided information is true, accurate, and complete.

8. Listing Rights

Encore by Welltek may display listings on other websites and social media. Encore by Welltek may use, distribute, modify, and publicly display listing content.

9. Termination

After the initial 60 days, either party may terminate with written notice. The contract auto-renews monthly if not terminated.

1. Payment

• Accepts cash (in-store), major credit cards, and checks

• 50% deposit required; balance due at delivery

• Orders under $10,000 require full prepayment

• Declined charges remain buyer's responsibility within 10 business days

2. Transportation

• Buyer responsible for delivery costs

• Encore by Welltek not responsible for transit damage

• Buyer must inspect upon delivery and note discrepancies immediately

• Risk transfers to buyer upon lifting items from Encore by Welltek premises

3. Delivery and Installation

Included services cover cleaning, debris removal, and documentation. Buyer is responsible for electrician services and associated labor.

4. Returns

There is a 3-day window from pickup/delivery to report misrepresentation. Items must be in original condition for refunds. After the three-day return period, ALL SALES ARE FINAL. Prices are non-refundable after this period.

5. Miscellaneous Terms

• Items sold without warranties

• Encore by Welltek does not guarantee that listings are fully accurate

• Items cannot be duplicated if unavailable

• Encore by Welltek not responsible for listing accuracy provided by consignors

1. Taxes

Encore by Welltek is not responsible for sales, use, or personal property taxes beyond their own income taxes.

2. Indemnification

Users agree to indemnify Encore by Welltek for all liability, including legal fees, arising from service use or purchases.

3. Intellectual Property

All Encore by Welltek names, trademarks, logos, and website content are exclusive Encore by Welltek property and protected by copyright.

4. Security

No internet transmission is completely secure; Encore by Welltek cannot guarantee information security.

5. Errors and Delays

Encore by Welltek is not responsible for communication errors or technical delays.

6. Warranty Disclaimer

Services are provided "AS IS" and "AS AVAILABLE" without warranties. YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR ACCESS TO AND USE OF THE SERVICES IS AT YOUR SOLE RISK.

7. Limitation of Liability

Maximum aggregate liability is capped at $50. Encore by Welltek is not liable for indirect, consequential, or punitive damages.

8. Jurisdiction

Disputes are governed by California law and adjudicated in California Superior Court.

9. Site Modification

Encore by Welltek may modify terms at any time. Changes are effective 24 hours after posting.

10. Severability

Invalid terms are severed without affecting remaining terms.

11. No Waiver

Encore by Welltek's failure to enforce terms doesn't constitute waiver of future breaches.
